These General Terms and Conditions define the terms of sale and use on
the website www.maisondesvinsdecheverny.fr from which the
products distributed by the Association Maison des vins de Cheverny are marketed.

2 / Scope of application
These General Terms and Conditions of Sale apply to all orders placed through the website www.maisondesvinsdecheverny.fr and to all orders received by mail, regardless of any clauses that may appear on the buyer’s documents.
The customer acknowledges having read these General Terms and Conditions of Sale and accepting their terms.
In the event of a case not covered by these General Terms and Conditions of Sale, the distance selling rules of the location where the company’s headquarters are located shall apply.

3 / Presentation and description of products
The website presents the various products it offers for sale, as well as their detailed descriptions contained in product sheets, offering the customer the possibility to know the essential characteristics of each product they can purchase via the site before placing a final order, in accordance with the provisions of Article L.111-1 of the Consumer Code.
The information mentioned on each product sheet as well as their photograph(s) are provided by the respective suppliers and/or are produced by the Maison des vins de Cheverny.
In this regard, the Maison des vins de Cheverny does its best to ensure that the color, pattern, and presentation of the products whose photographs are displayed on the site are faithful to the original products.
However, it is possible that the photographic representation of the products may not correspond exactly to the product itself. The photographs, texts, graphics, and information reproduced and illustrating the products do not fall within the contractual scope. In the event of a manifest error between the characteristics of the products and their representation, the Maison des vins de Cheverny shall not be held liable.
3 / Orders
Maison des Vins de Cheverny undertakes to accept orders placed via the Internet under the terms of these General Terms and Conditions of Sale and within the limit of available stocks.
In the event of a stockout, we will inform you of the supply times required to obtain the desired product, or we will offer you a replacement product from the following vintage or an equivalent or higher quality product under the same pricing conditions. Maison des Vins de Cheverny will honor each order by making one or more deliveries of the products ordered.
Any order will only be taken into consideration after receipt of payment and will be confirmed by Maison des Vins de Cheverny by email or telephone.
Maison des Vins reserves the right to cancel any orders that are non-compliant or suspicious, as well as those from a customer with whom there is any ongoing dispute.
4 / Prices
The prices indicated are expressed in euros and include all taxes (applicable VAT, excise duties, and all other applicable taxes). The displayed prices are net and exclude participation in shipping and delivery costs. These shipping costs vary depending on the number of products ordered and the shipping destination.
5 / Validity of offers
Products are offered within the limit of available stocks.
Maison des Vins cannot be held responsible for any stock shortage that might lead to a delay in the delivery of the order.
In the event of unavailability of one or more products after validation of the order, Maison des Vins undertakes to inform the customer by e-mail or by telephone as soon as possible. In agreement with the customer, Maison des Vins may modify the order, or will proceed with the refund of the unavailable product(s) by check or bank transfer.
At any time and without prior notice, Maison des vins de Cheverny reserves the right to modify the price of products, provided that these modifications do not affect orders that Maison des vins de Cheverny has accepted before these modifications came into effect.
6 / Delivery
Maisondesvinsdecheverny.fr delivers throughout France.
Deliveries to any other destination must be subject to a specific quote. The wines come from the estates of the Cheverny and Cour Cheverny AOC winegrowers and are stored in our Maison des Vins located in Cheverny. The delivery time for orders is 10 working days after receipt of payment. Non-working days include Saturdays, Sundays, and public holidays, as well as days when road transport is prohibited. These timeframes are indicated in the order confirmation received by the customer via email.
The order is delivered to the delivery address chosen by the customer. The customer is required to carefully check their packages upon delivery in order to immediately report any potential reservations to the carrier.
It is also possible to collect your order directly from the Maison des Vins de Cheverny.
7 / Right of return
In application of the provisions of Article L.121-16 of the Consumer Code, the buyer has a period of 14 clear days from the delivery of their order to return the delivered item for exchange or refund, at the buyer’s choice, without penalties except for the return shipping costs.
Return shipping costs are the responsibility of the customer. Maison des vins undertakes to refund the customer, with the exception of the outbound and return shipping costs which remain their responsibility. The refund occurs within two weeks after receipt of the return.
Returns must be sent to Maison des Vins de Cheverny, 1 avenue du château – 41700 CHEVERNY.
For exchange or refund, the bottles must be in good condition and in their original packaging.
7 / Payment
Payment for products purchased from Maisondesvinsdecheverny.fr is payable in full upon ordering. Payments can be made by credit card (secure online payment via Crédit Agricole), by check made payable to La Maison des Vins de Cheverny, or by bank transfer.
8 / Retention of title
In accordance with the law of May 1, 1980, the products delivered to the customer are sold subject to retention of title. The transfer of ownership is subject to the full payment of the price of the products by the customer, at the maturity date agreed upon between the parties.
In the event of non-payment of the total price of the goods by the agreed maturity date, La Maison des Vins de Cheverny may claim ownership of the products at the customer’s expense and risk.
9 / Personnal data
Membership to the site requires the customer to provide a certain amount of personal data concerning them.
This data, necessary for processing the order and managing the commercial relationships between Maison des Vins de Cheverny and its customers, is secured, kept confidential, and is not subject to any commercial use by third parties.
In accordance with Law No. 78-17 of January 6, 1978, relating to information technology, files, and freedoms, the consumer has a right of access and rectification regarding any personal information concerning them. The processing of this information is declared to the CNIL under the number: 1172475.
10 / Guarantees
Maison des Vins de Cheverny is bound by the legal guarantee against hidden defects, within the meaning of Article 1641 and following of the Civil Code: “The seller is bound by the guarantee regarding hidden defects of the item which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lower price, if they had known about them.” Consequently, the customer has up to 2 months after the delivery date to submit their complaint to Maison des Vins de Cheverny. Beyond this period, Maison des Vins de Cheverny can no longer guarantee the wines and the customer must prove that the alteration of the wine predates the receipt of the wine. A return of the problematic sample will be necessary for analysis.
Express waiver of the application of Article 1587 of the Civil Code
The quality of a wine depends in part on subjective elements. The customer is expected to have a good knowledge of our wines. They are required to ensure the conformity of the wines on the day of their receipt. No return will be accepted unless it has been subject to prior agreement with the shop.
The buyer waives the benefit of Article 1587 of the Civil Code, relating to tasting and approval, and accepts any variation within the limit of the analytical standards of the selected wine(s).
If, however, the quality of the wine is questioned (corked wine, volatile acidity above the standard, etc.), the customer will be referred to the winemaker so that the latter may act accordingly.
11 / Responsability
All texts and photos presented are for informational purposes only and are in no way contractual.
Maison des Vins de Cheverny markets the products offered on the site Maisondesvinsdecheverny.fr, in the name and on behalf of the suppliers (winemakers or producers). Maison des Vins de Cheverny shall not be held liable in the event of inaccuracy, non-conformity, or any failure regarding the quality of the wines ordered.
Maison des Vins de Cheverny will forward any complaint from a customer to the relevant supplier as soon as possible.
12 / Application right
The language of this contract is French.
All clauses of these General Terms and Conditions of Sale, all transactions and purchase operations carried out from the Maisondesvinsdecheverny.fr website as well as by mail are governed by French Law.
Any dispute that has not reached an amicable settlement shall be within the jurisdiction of the Courts of the registered office of La Maison des Vins de Cheverny or the court of the department chosen by the customer.
13 / Protection of minors
In accordance with Article L. 3342-1 of the Public Health Code, the sale of alcohol to minors is prohibited. The member undertakes to be at least 18 years of age when placing their order.
